Breaking A Lease
Question: My son is renting a house in Rochester Hills. The lease isn't up until December, however, he has lost his job and is returning to Ohio. What does he need to do about breaking the lease?
Answer: Your son may want to hire an Attorney to look at his specific lease and give him legal advice. While on the bare facts I cannot give him legal advice, I can pass on that if the landlord in Michigan is forced to send a "Notice to Quit" for nonpayment of rent, and suit to terminate the lease and collect the amount unpaid, that the lease then becomes terminated by the terms of the Notice. If the tenant tells the landlord they are moving and requests the landlord to end the lease, the landlord usually does not. The landlord would allow the lease to stay in place until he relent the premises and then sue for the entire unpaid balance. Good luck for your son.
