Denied Rights To Road Access
Question: Recently I purchased land in Southwestern Michigan from our neighbors who shared the same road access for both, we were told that we no longer had access to the road to the property is this legal?
Answer: Thank you for your note regarding access. We assist many clients with easement and real estate matters. Your question would pose a most upsetting issue. Access to property is an essential right. The Michigan Subdivision Control Act requires notice to parties that a property is not on a public road. To give you an answer I would need to look at your closing documents: The Deed, Title Insurance Commitment or Policy, your Purchase Agreement and a drawing, survey or tax map of the property showing the road you thought you had rights to but are now being told you don't. We can look at these documents and discuss the matter with you and make our recommendations
